Understanding Divorce & Matrimonial Finance

Expert Representation in Divorce and Financial Settlements

Divorce in England and Wales is more than the legal ending of a marriage or civil partnership. While the divorce process itself has been simplified under the no-fault divorce regime, the financial consequences remain complex and often contested.

The legal process begins with an application for divorce. Once the conditional order is granted and the final order is made, the marriage is dissolved. However, the final order does not automatically resolve questions of property, pensions, savings, businesses, maintenance or future financial claims. Those issues are dealt with separately through financial remedy proceedings.

Without a court-approved financial order, either party can still make claims against the other years after the divorce is finalised. This is why experienced representation is essential. A carefully negotiated or court-ordered settlement provides certainty, finality and protection.

Seema Kansal is a family law barrister practising from FOURTEEN Chambers at 14 Gray’s Inn Square, London. She specialises in divorce and matrimonial finance, advising both solicitors and members of the public through the Direct Access scheme. Her work covers straightforward financial settlements as well as high-value and complex cases involving business assets, hidden wealth, overseas property, trusts and significant pension funds.

Clients instruct Seema for clear, realistic advice on the strengths and weaknesses of their position, strategic negotiation, drafting of consent orders, and robust advocacy at Financial Dispute Resolution hearings and final hearings in the Family Court, High Court and, where necessary, the Court of Appeal.

Why Choose Seema Kansal

Experience, Strategy and Clear Advice in Divorce Finance

Choosing the right barrister for divorce and matrimonial finance is a decision that can shape the financial outcome of the case and the level of stress experienced throughout the process.

Seema Kansal brings over 17 years of experience at the family Bar. She practises exclusively in family law from FOURTEEN Chambers in Gray’s Inn, London, and appears regularly in the Family Court, High Court and Court of Appeal. Her practice focuses on divorce and financial remedy proceedings, including high-value and complex cases involving business assets, pensions, overseas property and disputed disclosure.

Complex financial disputes require more than general family law knowledge. They demand a detailed understanding of asset valuation, the treatment of non-matrimonial property, liquidity issues in businesses, and the practical enforceability of any order made. Seema approaches every case with meticulous preparation: disclosure is analysed carefully, weaknesses in the other party’s case are identified early, and realistic settlement parameters are established from the outset.

Strategic negotiation is a core part of her work. Many financial remedy cases settle at or before the Financial Dispute Resolution hearing. Seema’s ability to present a clear, well-supported position often creates the conditions for a constructive settlement. Where settlement is not possible, she provides focused, confident advocacy at final hearings.

Clients who instruct Seema through Direct Access particularly value the ability to speak directly with the barrister who will conduct the advocacy and advise on strategy. This removes layers of communication and can reduce overall costs, while still allowing a solicitor to be instructed for specific tasks if needed.

Above all, Seema’s approach is client-focused. Divorce and financial disputes are rarely purely legal exercises; they involve homes, businesses, pensions and future security. Understanding what genuinely matters to the client allows a strategy to be built around those priorities rather than abstract legal positions.

The Process

How It Works

1
Initial Consultation A confidential discussion to understand your circumstances, priorities and the stage your divorce or financial proceedings have reached.
2
Case Review Detailed review of the relevant documents, Form E disclosure and the factual background. Strengths, risks and realistic settlement ranges are assessed.
3
Financial Assessment Analysis of the full financial picture — property, pensions, businesses, savings, investments and any overseas or trust assets.
4
Negotiation / Court Strategic negotiation aimed at achieving a fair settlement. Where agreement cannot be reached, skilled advocacy at FDR and final hearings.
5
Settlement / Resolution Recording of any agreement in a carefully drafted consent order, or obtaining a final order from the court.

Frequently Asked Questions

Common Questions About Divorce & Finance

What does a Divorce Barrister do?
A divorce barrister provides specialist legal advice and represents clients in court on the financial consequences of divorce, including property division, pensions, maintenance and the drafting of binding financial orders. Barristers are advocacy specialists trained for complex legal argument and courtroom representation.
Do I need a Barrister for Divorce?
Not every divorce requires a barrister. However, where finances are complex, assets are substantial, disclosure is disputed, or the case is likely to proceed to a contested hearing, specialist barrister advice and representation can make a material difference to the outcome.
How is property divided after divorce?
There is no fixed formula. The court considers a range of factors under section 25 of the Matrimonial Causes Act 1973, including the needs of each party and any children, the length of the marriage, contributions, and the resources available. The aim is a fair outcome in all the circumstances.
What is a Financial Consent Order?
A financial consent order is a court order that records an agreed financial settlement and makes it legally binding. Once approved by the court, it prevents either party from making further financial claims arising from the marriage (subject to limited exceptions).
What is a Clean Break Order?
A clean break order ends all ongoing financial claims between the parties. Neither spouse can later seek maintenance or a further share of assets. It provides long-term certainty and is often the preferred outcome where the resources allow it.
Can pensions be divided?
Yes. Pensions are frequently one of the most valuable assets in a marriage. They can be shared by a pension sharing order, offset against other assets, or, less commonly, the subject of a pension attachment order. Specialist advice is essential.
What happens if my spouse hides assets?
Non-disclosure can be addressed through court orders for further disclosure, third-party disclosure, forensic accountancy evidence, and, in serious cases, adverse inferences or costs orders. Early and robust case management is critical.
Can I instruct Seema directly?
Yes. Through the Direct Access (Public Access) scheme, members of the public can instruct Seema Kansal directly for advice, drafting, negotiation and court representation in divorce and financial remedy matters without first instructing a solicitor.
How long does divorce take?
An uncontested divorce can be finalised in approximately six months, subject to court processing times. Resolving the financial aspects often takes longer, particularly in complex or contested cases. Many financial cases settle at or before the FDR hearing.
How much does a Divorce Barrister cost?
Fees depend on the complexity of the case, the volume of documentation, and whether the matter proceeds to a contested final hearing. Fees are discussed transparently at the outset. See the Fees page for further information.
